Who sells products on JoyPicks?
Every product currently listed on JoyPicks is sold by HYGGO PTY LTD (ABN 26 680 569 653), trading as JoyPicks. The stores on JoyPicks group the range of our supply partners, mainly clothing manufacturers and wholesalers, and those supply partners may dispatch orders directly to buyers. However, the contract of sale is with HYGGO PTY LTD (ABN 26 680 569 653), trading as JoyPicks. We handle customer service, delivery problems, returns, refunds and intellectual property complaints.
If a listing is ever sold by an independent seller, that seller will be named on the listing and will be the seller of record. Today, all products are sold by us.
What is not allowed?
Products, listings and listing content on JoyPicks must not infringe another person's or company's intellectual property rights. Anyone providing products or content for a listing must make sure they have the right to sell the product and to use all images, text, branding and other materials in the listing.
The following are not allowed:
- Counterfeit goods - items bearing a trade mark, logo, branding or other sign without the owner's permission, or items that imitate a branded product in a way that is likely to mislead buyers about origin, sponsorship or authenticity.
- Copyright-infringing items - unauthorised copies of books, films, music, software, games, artwork, photographs or other protected works.
- Listings that copy protected content - using another brand's, photographer's or seller's images, videos, logos, text or product descriptions without permission.
- Design or patent infringement - products that infringe registered designs, patents or similar rights.
- Misleading trade mark use in listings - using another brand's name or trade mark in a misleading way, including wording that suggests an association, endorsement or compatibility that does not exist.
- False claims of authenticity or authorisation - describing goods as official, authorised, genuine or equivalent unless that claim is true and can be supported.
Genuine branded goods may be sold where they have been lawfully obtained and are accurately described. However, even where a product is genuine, that does not by itself give permission to copy a brand owner's photos, catalogue text or other protected content.
How do I report infringement?
If you own intellectual property rights, or are authorised to act for the owner, you can ask us to review an allegedly infringing listing by emailing [email protected] with the subject line IP complaint. Please send complete information so we can assess the report properly.
What should an IP complaint include?
- Your full name, organisation if any, email address and phone number.
- The intellectual property right you rely on, for example a trade mark registration number, copyright work details, registered design number or patent number.
- Evidence that you own the right or are authorised to act for the owner.
- The web link to each listing you are reporting.
- An explanation of why each listing allegedly infringes your rights.
- A statement that you have a good faith belief that the use complained of is not authorised by the rights owner, its agent or the law.
- A statement that the information in your notice is accurate and that you are the rights owner or authorised to act on the owner's behalf.
If your complaint concerns copyright, it also helps to include links to the original work, dates of creation or first publication, and any registration or deposit details if available.
What happens after I send a report?
- Review: we review the notice. If it is incomplete or unclear, we may ask for more information.
- Action: if the notice appears valid, we may remove or disable the listing, pause sales of the item, cancel affected orders before dispatch and refund buyers in full where appropriate.
- Information sharing: to allow the matter to be answered fairly, we may share the complaint details, including your contact details and the basis of the complaint, with the affected seller or supply partner.
- Response: the affected seller or supply partner may send a counter-notice if they believe the listing was removed by mistake.
- Outcome: we will let you know what action we have taken.
We aim to review complete notices promptly, but timing depends on the complexity of the complaint and the quality of the information provided. We may also remove or restrict listings on our own initiative if we reasonably believe they are counterfeit, misleading or otherwise infringing.
How does a seller or supply partner send a counter-notice?
If your listing was removed and you believe that was a mistake, email [email protected] with the subject line IP counter-notice.
What should a counter-notice include?
- your name, seller name and contact details
- the listing or listings removed
- an explanation of why you believe the removal was incorrect
- supporting evidence, such as invoices from an authorised supplier, a licence, trade mark authorisation, proof that the content is original, or other relevant documents
- a statement that the information you provide is accurate
We may share your counter-notice with the person who made the original report. We may reinstate the listing if we are satisfied it does not infringe, unless the rights owner shows that legal proceedings have started or provides other persuasive evidence that the listing should remain offline. JoyPicks does not decide court disputes about intellectual property ownership or validity. Those disputes must be resolved by the parties or by a court or other competent authority.
What happens to repeat infringers?
Listings that appear to infringe may be removed without prior notice. Sellers or supply partners who repeatedly list infringing or counterfeit items may have listings removed, accounts suspended or accounts closed. We may also cancel affected orders before dispatch and refund buyers in full.
If counterfeit or infringing goods have already been sold, we may provide buyer remedies in line with our Buyer Protection, Returns Policy and applicable consumer laws.
What should buyers do if they receive a counterfeit or infringing item?
If you believe you received a counterfeit item, an unauthorised copy, or an item that is otherwise faulty, wrong or not as described, email [email protected] with your order number and clear photos showing the issue. Please use the subject line Counterfeit item received.
If the item is counterfeit, faulty, wrong or not as described, you are covered at no cost to you. We will offer an appropriate remedy such as a repair, replacement or refund, and we will pay the return cost or tell you that no return is needed. Refunds are sent to the original payment method and, once issued, usually appear within 3-10 business days. This is in addition to your rights under our Buyer Protection and Returns Policy, and your statutory rights under applicable law.
How does this relate to your consumer rights?
Our policy: if an item is counterfeit, infringing, faulty, wrong or not as described, we will put it right at no cost to the buyer through a repair, replacement or refund, and we will pay the return cost or confirm that no return is needed.
Your statutory rights: consumer protection laws apply in addition to this policy and are not limited by it. Depending on where you live, these may include the 2-year legal guarantee of conformity in the EU, the UK Consumer Rights Act 2015, the Australian Consumer Law and New Zealand's Consumer Guarantees Act.
What if a report is false or abusive?
Please only report listings you genuinely believe infringe your rights. Knowingly false, misleading or abusive reports may result in us disregarding future reports from you. Making false allegations may also expose you to legal liability under the laws that apply to you.
How do we handle personal information in IP complaints?

We use the information you provide to review the complaint or counter-notice, contact the parties involved, enforce our policies, comply with legal obligations and keep records of our decisions. We may share complaint or counter-notice details with the affected seller, supply partner, rights holder, professional advisers or authorities where reasonably necessary.
To fulfil orders and investigate complaints, we may disclose name, delivery address, phone number and order details to the supply partner sending the item, mainly in China. We also use service providers including Stripe, PayPal, our hosting and email providers in Australia, Cloudflare and Google.
