This policy explains what cannot be sold on JoyPicks, and what may be sold only if extra legal and safety requirements are met. Every product offered on JoyPicks must be legal to sell, legal to export and import, and safe for consumers in the places we deliver to. This policy applies to all listings on JoyPicks, including any listing offered by HYGGO PTY LTD (ABN 26 680 569 653), trading as JoyPicks and any listing that may in future be offered by an independent seller. The contract of sale for products sold by us is with HYGGO PTY LTD (ABN 26 680 569 653), trading as JoyPicks. We handle customer service, delivery problems, returns and refunds. Today all products on JoyPicks are sold by HYGGO PTY LTD (ABN 26 680 569 653), trading as JoyPicks. If a listing is ever sold by an independent seller, that seller will be named on the listing.

Sellers are responsible for knowing and following all laws, regulations, standards and import rules that apply to their products, including the laws of the country where the item is offered, the origin country and the destination country. This page is a guide only and is not a complete list. If an item is unlawful, unsafe or restricted in a way that prevents lawful sale or delivery, it is prohibited on JoyPicks even if it is not specifically listed below.

What items are prohibited?

These items must not be listed, sold or supplied through JoyPicks.

Weapons

• firearms, firearm parts and accessories, ammunition and explosives
• replica or imitation firearms, gel blasters and any other items regulated as firearms or prohibited weapons in any place where they are regulated that way
• prohibited weapons such as flick knives, butterfly knives, knuckle dusters, batons, throwing stars, crossbows, stun guns, tasers and pepper or capsicum spray
• laser pointers above permitted power limits or otherwise unlawful to possess or import
• instructions, kits or components primarily intended for making weapons or explosives

Drugs, medicines and related items

• illegal drugs, controlled substances and drug paraphernalia
• prescription-only medicines, and therapeutic goods including medical devices, where legally required approvals, registrations, clearances or authorisations are missing
• products making unlawful therapeutic, medical or health claims
• nicotine vaping products, e-cigarettes and vaping accessories, and tobacco or tobacco products
• alcohol

Counterfeit and infringing goods

• counterfeit goods, replicas and inspired by copies that use another brand's trade marks or branding
• items that infringe copyright, trade marks, designs, patents or other intellectual property rights
• unauthorised copies of software, media, games or digital content

Unsafe, banned and recalled products

• products subject to a recall in a country where JoyPicks ships
• products subject to a permanent or interim ban under consumer or product safety laws that apply to the product, seller or destination
• products that do not comply with an applicable mandatory safety standard or information standard, including:

• products containing button or coin batteries that do not meet applicable safety and information standards, including secure battery compartments, testing and required warnings on the product and packaging
• furniture that does not meet applicable anti-topple or stability requirements, including required testing and warning labels
• children's products and toys that do not meet applicable standards, for example standards relating to small parts, cots, baby walkers, children's nightwear and toys containing magnets
• bicycle helmets, sunglasses and any other products covered by a mandatory safety or information standard that are not compliant

• electrical products that do not meet applicable electrical safety requirements, approvals, certification, marking or labelling rules
• gas appliances that are not certified or approved for lawful use in the country where they are sold
• products that are otherwise unsafe, defective or likely to cause injury when used as intended or in a reasonably foreseeable way

Dangerous goods

• hazardous chemicals, poisons, flammable liquids and gases, fireworks and pyrotechnics
• items that cannot be lawfully or safely shipped by the carrier used, including loose lithium batteries where restricted or prohibited

Animals, plants and biosecurity

• live animals, and products made from protected or endangered species
• seeds, plants, soil, and food or animal products that breach quarantine, biosecurity or import rules in the destination country

Illegal, offensive and harmful items

• stolen goods
• government documents, identity documents, licences, number plates, uniforms or badges that could be used to impersonate officials
• currency, counterfeit money, and payment cards or gift cards
• personal information, accounts, passwords or hacking tools
• surveillance devices intended for unlawful use
• items that promote or glorify violence, hatred or discrimination, including Nazi symbols where prohibited by law
• material that is refused classification or otherwise illegal in the country where it is sold, and any sexual material involving minors
• human remains and body parts

What items are restricted?

These items may be sold only if all applicable laws, standards, labelling rules, age restrictions, import rules and platform requirements are met. If those conditions cannot be met, the item must not be listed.

Adult items (18+)

• Adult products are not sold on JoyPicks and must not be listed.

Other restricted items

• Knives and tools with blades such as kitchen knives, camping knives and multi-tools may be sold only where legal, must not be marketed as weapons, and must comply with any age restrictions and other laws that apply.
• Food, supplements and cosmetics must meet all applicable ingredient, safety, labelling, packaging and import requirements in the places where they are offered and delivered.
• Electrical products must meet applicable safety, certification and approval requirements and must be supplied with a suitable plug or adaptor where required by law or safe use.
• Products with safety warnings must display all required warnings, instructions and labels in the listing and on the product or packaging where required.

How do country, delivery and import restrictions affect listings?

JoyPicks delivers to 222 countries and territories shown in the Ship to list in the site header. We do not deliver to mainland China, Hong Kong, Macau, Taiwan, Russia, Belarus, North Korea, Iran, Syria or Cuba. A product may still be prohibited on JoyPicks if it cannot lawfully be imported into one or more destination countries we serve, or if the carrier will not carry it.

Because orders may be sent directly to the buyer by one of our supply partners, sellers must make sure the product can be lawfully exported from the origin country and imported into the destination country, with any required labelling, testing, documentation or approvals in place before listing.

Shipping is free to every country we ship to, but free shipping does not mean every product can be shipped everywhere. Dispatch and delivery remain subject to legal restrictions, carrier rules and customs requirements. For delivery times, tracking, taxes and duties, see our Shipping Policy.

What happens if this policy is broken?

We may refuse, remove or edit listings, cancel orders before dispatch and issue a full refund where appropriate, withhold payouts where permitted by our Marketplace Seller Agreement, and suspend or close seller accounts. If a price or product detail is obviously wrong, we may also cancel the order and refund it in full before dispatch. Where required or appropriate by law, safety obligations or regulatory requests, we may report matters to relevant authorities, rights holders, payment providers, carriers or product safety bodies.

If a listed item creates a safety, legal or compliance risk after sale, we may also contact affected customers, stop further sales, arrange returns, refunds, repairs or replacements, or take other steps required by law or our Buyer Protection, Returns & Refunds Policy or Product Safety & Recalls policy.

If JoyPicks ever stops trading, HYGGO PTY LTD (ABN 26 680 569 653), trading as JoyPicks remains responsible for orders already placed, refunds and claims.

Which law applies?

This policy is governed by the law of Victoria, Australia, without taking away the mandatory consumer protections of the buyer's own country where those protections apply.
